If you use the planet buster on the Grox Planets, do you still lose points with your allies?
I should think that it would be no, but I'm probably wrong.

good question I dont know it would make sense but eitherway id just go with making it T1 and not waste 5mil

Yes, if you're close enough to an empire to lose points for breaking the galactic code, then yes you'll lose points. There is a max distance that affects you though.

10 parsecs is the range on Breaking the Galactic Code iirc.
